Compliance with State Laws

Currently, Shire is reporting, and will continue to report, spending on HCPs to a limited number of states as required by the individual state laws.  Each law has its own reporting requirements, which can include the following:

  • Types of health care professionals (MD, DO, NP, PA, RN, etc…)
  • Due dates (vary throughout the year)
  • Reporting period (calendar year)
  • Most states require information on meals, travel and fee-for-service arrangements

Compliance with Federal Law:  Patient Protection and Affordable Care Act - Physician Payments Sunshine Provision

In March of 2010, Congress passed the Patient Protection and Affordable Care Act (PPACA), which included the Physician Payments Sunshine Act (PPSA). This act applies to all manufacturers of prescription drugs and medical devices.On December 19, 2011 CMS released proposed regulations. The most immediate impact of the proposed regulations is a delay in the commencement of the reporting period, which was initally scheduled to begin on January 1, 2012. Shire is reviewing the proposed regulations and will update this site in the future.

Required information that will be reported: 

  • Name
  • Business address
  • Physician specialty 
  • National provider identifier
  • Value of the payment or transfer of value 
  • Name of the related drug or device
  • A description of the form of payment  
        - Cash or cash equivalent
        - In-kind items of services
  • Drug samples: product name, quantity, date, and dosage units of the sample
